ANSWER
NO!
There’s NOTHING WRONG with the one performing hajj to cut his hair or nails in the first ten days of Dhul Hijjah as long as he’s not in the state of ihraam.
The order to refrain from cutting the hair and nails in the first ten days of Dhul Hijjah DOES NOT APPLY to him.
Actually this is a VERY COMMON MISCONCEPTION among those of us who don’t understand ARABIC.
We should be very CLEAR that it IS ALLOWED for a Haaji to cut his hair and nails even after the first of Dhul-Hijjah, as long as he’s not in ihraam.
📌 PROOF #1:
🍃 It’s true that the Prophet sal Allaahu Alayhi wa sallam said:
“When you see the new moon of Dhu’l-Hijjah, and one of you wants to offer a sacrifice, let him refrain from (removing anything) from his hair or nails.” (Muslim)
But this hadeeth applies to the one who is NOT going for Hajj and he’s offering UDHIYAH.
🔺 How can I say that?
In order to explain that, let’s learn some ARABIC terms.
The animal sacrifice that the Haaji offers is called a Hadiy.
A Hadiy is ONLY done in MAKKAH.
The animal sacrifice that’s done by those who are NOT performing hajj, on Eid day, in their own countries, is called Udhiyah.
These are TWO DIFFERENT SACRIFICES.
People get confused because they don’t know Arabic and they’re reading the hadeeth in English where the word “sacrifice” is used for BOTH “Udhiyah” AND “Hadiy”
And that’s why it’s VITAL to study Deen and look at the texts in ARABIC.
Allaah Subhaanahu wa Ta’aala revealed this Deen and its rulings in ARABIC.
And NOT in English or any other language.
Whenever we look at ANY issue, we MUST refer to the Arabic and NOT the “INTERPRETATION’ of it in any other language.
ALWAYS remember, people and their interpretations can be WRONG.
But what Allaah has revealed in the Qur’aan or in the authentic ahaadeeth in ARABIC REMAINS INTACT.
By looking at the above hadeeth of the Prophet Sal Allaahu Alaiyhi wa Sallam in ARABIC, we see that the WORD that the Prophet sal Allaahu Alayhi wa sallam used in the hadeeth is for “Udhiyah”
He DID NOT use the word for “Hadiy”.
That proves that the Prophet sal Allaahu Alayhi wa sallam is talking about the one offering the sacrifice for Eid back home and he’s NOT talking about the one going for Hajj.
If he was talking about the Haaji, he would have used the word ‘hadiy’.
🔺 PROOF #2:
If someone is doing hajj tamattu, they do umrah first.
Then they get OUT of ihraam. Correct?
🔺THINK:
What do they have to do to get out of ihraam?
They have to…”CUT” their hair.
If it was not allowed for the Haaji to cut his nails and hair from the first of Dhul-Hijjah, how would he be able to get out of ihraam if he did umrah in the first few days of Dhul-Hijjah?
Makes sense, right?
🍃 Someone asked Shaikh Ibn Baaz about a HAAJI offering a sacrifice AT HOME along with his Hadiy that he offers in Makkah; and if he can cut his hair.
The shaikh said:
“He HAS to shave his head or cut his hair, regardless of whether he is appointed to offer the UDHIYAH on behalf of someone else or is offering it on his own behalf.
He MUST do that if he is doing tamattu‘, after completing his ‘umrah, before doing any of the things that are prohibited whilst in ihraam.”

🍃 And Shaykh Ibn ‘Uthaymeen said:
“When the pilgrim has done ‘Umrah, he must cut his hair, even if he wants to offer an udhiyah in his OWN COUNTRY, because cutting the hair following ‘Umrah is one of the rituals.”

🔺 PONDER over the words of Shaikh Ibn Baaz and Ibn Uthaymeen...
Shaikh Ibn Uthaymeen is saying:
“if he wants to offer an udhiyah in his OWN COUNTRY”
Those who know Arabic UNDERSTAND RIGHT AWAY that Udhiyah is done in your OWN COUNTRY and NOT at HAJJ.
🔺 PROOF #3:
Look at the REASON WHY the prohibition to cut the nails and hair is there:
Shaikh Ibn Baaz explains WHY the one offering an UDHIYAH refrains from cutting his hair and nails from the firstvof Dhul-Hijjah.
🍃 He said:
“The reason for this prohibition is that when the person, who wants to offer the udhiyah, joins the pilgrims in some of the rituals of Hajj – namely drawing closer to Allaah by slaughtering the sacrifice – he also joins him in some of the features of ihraam, namely refraining from cutting his hair etc.”

🍃 Imaam an Nawawi said:
“It is to show UNITY, SUPPORT and SOLIDARITY between the PILGRIMS and those that are NOT going for hajj.
This PROVES BEYOND DOUBT that the prohibition to cut hair and nails from the first of Dhul-Hijjah applies ONLY and ONLY to the one who’s NOT going for Hajj.
May Allaah open our hearts and give us TRUE understanding of the Deen.
